Requirements
Must:
- Juris Doctor (JD) from an accredited law school; active license in at least one U.S. jurisdiction, preferably Texas.
- 8-12+ years of experience in litigation, ideally combining law firm and in-house roles.
- Strong foundation in energy, midstream, oil & gas, or heavy industrial litigation.
- Proven track record of managing complex, high-stakes litigation and arbitration cases.
- Familiarity with pipeline safety regulations, environmental laws, and commercial contracts relevant to midstream operations.
- Excellent judgment, negotiation abilities, and the capacity to influence senior management.
- Adaptability in a dynamic, fast-paced environment with multiple priorities.
Responsibilities
- Lead all facets of litigation, arbitration, and administrative processes involving the company, encompassing case evaluation, strategy formulation, budgeting, and management of external counsel.
- Oversee a varied docket that includes commercial disputes, construction claims, environmental enforcement, personal injury, property damage, ROW and eminent domain issues, and regulatory challenges.
- Direct the discovery process, including document preservation, e-discovery, witness preparation, and expert involvement.
- Assess settlement prospects and negotiate resolutions that safeguard the companys financial and operational interests.
- Counsel Operations, EH&S, and Engineering on incident response, spill occurrences, pipeline integrity issues, and regulatory investigations.
- Assist with internal investigations tied to operational incidents, safety problems, or compliance issues.
- Engage with federal and state agencies (e.g., PHMSA, FERC, EPA, state environmental bodies) concerning enforcement actions, violations, and compliance issues.
- Provide legal expertise on pipeline safety regulations, environmental laws, and strategies for operational risk mitigation.
- Guide Commercial teams on contract interpretation, performance disagreements, indemnity concerns, and risk management.
- Aid in resolving disputes involving shippers, suppliers, contractors, and joint venture partners.
- Draft and negotiate settlement agreements, tolling agreements, and amendments related to disputes.
- Create and implement litigation management processes, reporting requirements, and metrics for executive teams.
- Train internal teams on litigation preparedness, document retention, and strategies for risk mitigation.
- Advise on insurance coverage, claims strategies, and liaise with insurers.
